1.1. These Terms and Conditions apply to the sale of goods through the website www.swisswine.ie.

1.3. We are an independent commercial entity. We are not an official governmental body and are not affiliated with any state-funded wine organisations in Ireland or Switzerland.


2. Who These Terms Apply To

2.1. These Terms apply to all orders placed through our website by customers located in the Republic of Ireland.
2.2. If you are a consumer, nothing in these Terms affects your mandatory statutory rights under the Irish Consumer Rights Act 2022 and applicable EU consumer laws.


3. Age Restriction

3.1. You must be 18 years of age or older to purchase alcohol from us.
3.2. By placing an order containing alcoholic products, you confirm that you are at least 18 years old.
3.3. We operate a strict age verification policy. Upon delivery, if the recipient appears to be under the age of 25, valid photographic identification (e.g., Passport, Driving Licence, or Garda Age Card) will be required to prove they are 18 or over.
3.4. If valid identification is not provided, delivery will be refused and the goods will be returned to us.


4. Products

4.1. We take reasonable care to ensure that product descriptions, prices, images and availability information are accurate.
4.2. Minor differences in packaging, labels, vintages or presentation may occur.
4.3. All products are offered subject to availability.


5. Ordering and Contract Formation

5.1. When you place an order through our website, you are making an offer to purchase goods from us.
5.2. A legally binding contract is formed only when we send you an order confirmation email accepting your order.
5.3. We may refuse or cancel an order before dispatch, including where: the goods are unavailable; there is an obvious pricing or listing error; we reasonably suspect fraud, misuse or unlawful activity; we cannot complete age verification or delivery compliance requirements; delivery to the requested address is not possible.
5.4. If we cancel an order after payment has been taken, we will refund you in full.


6. Prices and Taxes

6.1. All prices shown on the website are in Euro (€) unless otherwise stated.
6.2. As both the sender (Czech Republic) and the recipient (Ireland) are within the European Union Single Market, there are no additional import duties or customs clearance fees for the customer.
6.3. The total price shown at checkout includes Irish VAT and Irish Alcohol Excise Duty.
6.4. The price you pay at checkout is the final price delivered to your door in Ireland.


7. Payment Methods

7.1. We may accept payment by one or more of the following methods: Bitcoin or Satoshis; Lightning Network; PayPal; any other payment method displayed at checkout.
7.2. Payment must be successfully authorised before dispatch.


8. Cryptocurrency Payments

8.1. If you choose to pay in Bitcoin or Satoshis, you acknowledge that cryptocurrency values are volatile.
8.2. For a standard cancellation or change-of-mind return, any refund may be made in the same amount of Satoshis originally received by us, unless we agree otherwise or applicable law requires a different outcome.
8.3. Nothing in this clause limits your statutory rights in relation to faulty, damaged, misdescribed or non-delivered goods.
8.4. Where applicable law requires a refund by reference to the EUR (€) purchase price, we will comply with that law.


9. Delivery

9.1. We currently deliver within the Republic of Ireland.
9.2. Estimated delivery times are provided for information only and are not guaranteed.
9.3. Risk in the goods passes to you when the goods are delivered to the delivery address.
9.4. If delivery cannot be completed because age verification fails or the recipient is unavailable, we may charge you for reasonable return costs.


10. Ownership of Goods

10.1. Ownership of the goods passes to you only when we have received payment in full and the goods have been delivered.


11. Right of Withdrawal (Return of Goods)

11.1. In accordance with the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013, the consumer has the right to withdraw from this contract within 14 calendar days without giving any reason. The period begins on the day after the consumer receives the goods.
11.2. To exercise this right, the consumer must submit the request online via the official “Right of withdrawal” button located in the footer of the website www.swisswine.ie, or send an unequivocal statement to swisswine@swisswine.ie before the expiry of the deadline.
11.3. Returned products (wine bottles) must be intact, unopened, in their original packaging, and in perfect condition for resale. In accordance with applicable legislation, bottles opened by the consumer cannot be returned or refunded for reasons of hygiene and health protection.
11.4. The consumer may exercise the right of partial withdrawal and return only a portion of the ordered products. The direct costs of returning the goods shall be borne exclusively by the consumer.
11.5. In the event of a valid withdrawal, Swiss Wine shall reimburse all payments received for the returned products (including proportionate initial delivery costs if the entire order is returned) within 14 days from the day Swiss Wine is informed of the consumer’s decision. The reimbursement may be withheld until Swiss Wine has received the goods back or the consumer has supplied evidence of having sent back the goods.


12. Faulty, Damaged or Incorrect Goods

12.1. If goods are faulty, damaged or not as described, you are entitled to remedies under the Irish Consumer Rights Act 2022 and Directive (EU) 2019/771, including repair, replacement, or refund.
12.2. Please contact us as soon as possible at swisswine@swisswine.ie with your order number and photographs of the issue.


13. Our Right to Cancel

We may cancel a contract and refund you before dispatch if the goods are unavailable, we cannot deliver for legal reasons, or there is an obvious pricing error.


14. Promotions, Discounts and Vouchers

Promotions cannot be combined unless stated. Vouchers have no cash value, cannot be redeemed for cash, and may be modified prior to contract formation.


15. Independent Status Statement

15.1. www.swisswine.ie is an independent global e-commerce and distribution platform operated by Swiss Wine s.r.o.
15.2. We are not an official governmental entity and are not affiliated with any state-funded wine organisations in Ireland or Switzerland.


16. Limitation of Liability

16.1. Nothing in these Terms excludes or limits liability where it would be unlawful to do so under Irish and EU law.
16.2. We are not liable for indirect, consequential losses, or for delay caused by events outside our reasonable control (force majeure).


17. Privacy, Cookies and Data Protection

17.1. We process personal data in accordance with the General Data Protection Regulation (GDPR) and the Irish Data Protection Acts 1988–2018. See our Privacy Policy.
17.2. Cookies are used for: technical operation, statistical analysis, and marketing (with your consent).


18. Complaints

If you have a complaint, please contact us first at swisswine@swisswine.ie including your name, order number and a brief description of the issue.


19. Governing Law and Jurisdiction

19.1. These Terms are governed by Irish law and European law, ensuring the full application of mandatory consumer protection regulations.
19.2. You may bring legal proceedings in the Irish courts or via the European Online Dispute Resolution (ODR) platform available at: https://europa.eu.


20. Changes to These Terms

We may update these Terms from time to time. The version published on www.swisswine.ie at the time you place your order will apply to your contract.
